Legal opinion on Open Access in Switzerland

Open Access - access to scientific and scholarly publications in Swiss law

On the initiative of its Main Library, the University of Zurich commissioned Professor Dr Reto M. Hilty and Dr Matthias Seemann to draw up a legal opinion on Open Access. The opinion, which is entitled "Open Access - Zugang zu wissenschaftlichen Publikationen im schweizerischen Recht" [ Open Access - access to scientific and scholarly publications in Swiss law], is freely accessible on the University of Zurich's Open Access website. It focuses on legal issues surrounding the operation of repositories, i.e. Internet servers such as ZORA that provide Open Access to scholarly and scientific publications. In particular, it addresses the extent to which works that have already been published by scholarly publishers may be deposited in repositories.

Professor Dr. Hilty is a director at the Max Planck Institute for Intellectual Property, Competition and Tax Law in Munich and a professor of the law of immaterial goods at the University of Zurich.

Answers to FAQs about the legal opinion can be found here.

The texts will be translated into English and French in due course.
